Domestic Violence:
Is an aggressive behaviour within the home, typically involving the violent abuse of a spouse or partner. It is not only done by husbands but is an abuse even it is done by your parents, in-laws or other family members too. It includes sexual, physical, emotional, physiological violence, verbal, mental and physical abuse which can be further categorized as hitting, kicking, biting, slapping, shaking, pushing, pulling, punching, choking, beating, scratching, pinching, pulling hair, stabbing, shooting, drowning, burning, hitting with an object, threatening with a weapon, or threatening to physically assault.
The Protection of Women from Domestic Violence Act, 2005 (PWDV)
The Protection of Women from Domestic Violence Act 2005 is an Act of the Parliament of India enacted to protect women from domestic violence. It was brought into force by the Indian government and Ministry of Women and Child Development on 26 October 2006. The Act provides a definition of “domestic violence” for the first time in Indian law, with this definition being broad and including not only physical violence, but also other forms of violence such as emotional/verbal, sexual, and economic abuse. It is a civil law meant primarily for protection orders, rather than criminal enforcement.
Protection officer under Domestic Violence Act
Who is a protection officer and the role of the protection officer?
- An officer who is appointed by the state government to help enforce the PWDV act and as far as possible the officer should be a woman.
- The officer receives the complaints and files the report which is submitted to the magistrate, the officer helps the victim get medical help and also controls the shelter homes.
- He / She is the key officer working under Magistrate, who would be providing various relieves to aggrieved women in terms of monetary relief, counselling, legal aid, protection from the accused, social and economic security after investigating into the cases and preparing safety plan.
- To provide legal, therapy and other support services to an abused woman.
- Also to assist them secure the correct order under the act.
- To ensure that the order for monetary relief under section 20 is complied with and executed, in accordance with the procedure prescribed under the Code of Criminal Procedure, 1973
- To make sure that the aggrieved person is provided legal aid under the Legal Services Authorities Act, 1987 and see to it that it is free of cost in a prescribed form in which a complaint is to be made.
The Department of Women & Child Development, GNCT of Delhi has appointed 18 Protection Officers in all the Districts of Delhi. The Service Providers as per the Act have been identified to provide various services to aggrieved women like counselling, legal aid, shelter and health check-up. Workshops and training have been organized for the functionaries as stakeholders in the implementation of PWDV Act.
