INTRODUCTION
The right to education is a fundamental right for every citizen of India. Fundamental rights mean a group of rights that are recognized by the apex court which is the supreme court of India as requiring a high degree of protection from the government if any person violates any other person’s fundamental rights.
Fundamental rights are provided in the constitution of India or the Indian constitution. These rights are mentioned under part 3 of the Indian constitution. Fundamental rights are guaranteed under Articles 12 to 35 of the constitution of India.
There are six fundamental rights given to every Indian citizen; such as
- Right to equality
- Right to freedom
- Right against exploitation
- Right to freedom of religion
- Right to cultural and educational rights
- Constitutional remedies.
These six fundamental rights are given to every citizen of India even a newborn baby has these basic fundamental rights and if these rights are being violated by any person the aggrieved party has the right to claim remedies available to him or claim compensation for its violation of his right or rights.
Out of these six fundamental rights, one of the rights available to the citizen is the right to education.
In the year 2002, the 86th amendment of the constitution was passed and in this amendment added a new Article was introduced Article 21 (A) right to education a fundamental right.
Article 21 A of the Indian Constitution provides that;
“The state shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine.”
Explanation: Article 21 A of the Indian constitution provides (gives) all children the right to education for free and compulsory education in the age group of 6 to 14 years in India.
Education is one of the basic elements. Education is very important in building a better future for oneself and family and the growth and success of a democratic system of government. It is a basic human right because education gives a person human dignity who develops himself and also contributes to the development of the country. Later, after the amendment act 2002, the parliament passed the right to children to compulsory education act, 2009. The 2009 act aimed to provide \the responsibilities of the central and state government, teachers, parents, and community members to ensure that all children in the age group of six to fourteen years receive free and compulsory education. It was held in the case of Unni Krishnan vs the state of A.P.
SHIFTING FROM OFFLINE TO ONLINE ISSUES:
For approximately from past two years now, education for all children is online mode.
- Lack of access to devices and internet for poor; due to which the age group of 6-14 children has to quit their education and also had financial issues in this pandemic because of which they were left with no choice but to work on daily wages or some other works.
- Lack of knowledge of technology; the students have access to an online mode of education which means students must have knowledge related to technology but some students and parents still aren’t used to technology and because of this the children of the age group of 6-14 don’t pay much attention in the online mode of classes.
- Lack of conceptual clarity; as the students are experiencing an online mode of education most of the students have to face issues regarding the difficulties of the concept. Their basic concept doesn’t get clear due to which students, as well as teachers, will have to work harder in future times.
- Students have time but don’t utilize it properly; most of the children in the age group 6-14 are very young so they have a mindset that when we are at home or come back home we have free time or time for playing.
- Lack of critical thinking in students; students have lost their thinking capacity
- Students don’t actively participate in physical activities or online lectures; the reason can be students don’t pay much attention and either sleep while keeping their cameras off or they aren’t able to understand what teachers are teaching.
CONCERNS:
My concern is related to the online mode of education in the future. In the future, the pre-primary kids will be promoted to primary school and primary kids to secondary school (5th, 6th, 7th). My concern is if students haven’t able to clear their basic concepts in their initial grade how will they be able to connect things with their higher grades.
This concern is not only rigid in schools but also in colleges and also the same issues are faced by many students at their college levels also. These issues and concerns are not only in India but worldwide.
CONCLUSION
The government shall now start the offline mode of teachings for levels of education and also should watch carefully for the children who aren’t able to get access to their tight education due to their lack of availability or access to internet or devices or any other things which becomes an obstacle between children and education. As education is the fundamental right of a child they must get it and the one who can make it accessible to those poor or unaware citizens of India should make it. The constitution of India guaranteed the right to education to the child until the age of 14 but still due to this global pandemic they aren’t getting it. They should watch upon it and make it accessible to them and build confidence in the citizens of India that if nobody helps them or make their life better our Indian constitution and education can do.
