The right to freedom of religion forms an integral part of the fundamental right as embedded in our Indian Constitution. It is under Article 25 to 28 of our constitution. Since India is a multi-religion country, it was important for our constitution makers to give equal importance to all the religions. Article 25 to 28 is an attempt to keep these diverse religious sentiments of people in check.
In the famous case of S.R. Bomani v. Union of India, it was held that “secularism is a basic feature of the constitution”. The state should treat all its religion and religious activity equally. Religion is a matter of individual faith and it cannot be mixed with secular activities.
ARTICLE 25
It talks about freedom of conscience and free profession, practice and propagation of religion. These freedoms are subject to public order, health and morality. It regulates and restricts any economic, financial, political, and other secular activity which may be associated with religious practice. This article provides for the social welfare and reform or opening up of Hindu religious institution. It must be noted that Hindu word consists of Sikh, Jain, or Buddhist religion and their institutions should be constructed accordingly.
ARTICLE 26
This article talks about freedom to profess and practice any religion. It provides that all religious denominations have the following rights, subject to morality, health and public order:
To establish and maintain institutions for religious and charitable purposes.
The right to manage its own affairs in the matter of religion.
To own and acquire movable and immovable property.
To administer such property in accordance with the law.
ARTICLE 27
This article sates about the freedom of religion from payment of taxes for promotion of any religious activities. The object of this article was to secure that the public funds raised by taxes shall not be utilized for benefit of any particular religion or religious demonstration.
ARTICLE 28
This article talks about the freedom as to attendance at religious instruction or religious worship in certain educational institutions. It provides that institutions of educations which are completely funded by state, any kind of religious instructions cannot be provided. The exception to this is that any institute which is administered by state but has been established under any endowment or trust which requires that religious instruction shall be imparted in such institution. This article further states that any person attending an institute of education recognized by state, will not be required to take part in any religious instruction or religious worship.
