Environment is wellspring of land, water and soil and without any of these resources life of human beings are not possible and will completely be in danger if there is deficiency of these basic resources. And as we all know that Polluted environment directly impacts the life of human beings, so to have a better and healthy life we have to maintain a pollution free environment and also work to conserve resources by following the concept of sustainable development. So that our future generation will also have a great future.

At the time of independence, when consititution was framed then there was not any specific  provision regarding the protection of the environment because at that time the attention of the framers of the constitution was completely on economic growth, infrastructure and on other developments of the country. But when industrial activities, technological developments , use of machinery increased due to which pollution also increased, and pollution became a serious problem for the whole world.

At present the legislations enforced for the protection of environment are as follows:

• The forest conservation act,1980
• The wildlife protection act, 1972
• The national green tribunal act, 2010
• The air prevention and control of pollution act, 1981
• The water prevention and control of pollution act ,1974

So various international conventions were held for the protection of environment such as united nations conference on the human environment protection Stockholm, 1972, united nations conference on environment and development, Rio De Janerio in 1992 etc.

After these international convention, india also enacted many laws and rights for the protection of the environment and also added right to pollution free environment in article 21 of the constitution

But the main act i.e; The Environment Protection was enacted in 1986 with the objective of protection and improvement of the environment by implementing the decisions taken at the united nations conference on the human environment, 1972 Stockholm.

Role of PIL in right to pollution free environment:

PIL (public interest litigation) is a litigation filed in a court of law for the protection of public interest such as pollution, terrorism, road safety, constructional hazards etc. so PIL plays a major role for the pollution free environment.

The concept of PIL in india was recognized by justice P.N. Bhagwati. It overcomes the rule of locus standi.

Subash kumar v. state of bihar

It has been held that public interest litigation is maintainable for ensuring enjoyment of pollution free water and air which is included in the right to live under article 21 of the constitution.

M.C. Mehta v. union of india:

The petitioner brought a public interest litigation against the Ganga water pollution requiring the court to issue appropriate direction for the prevention of Ganga water pollution. The supreme  court ordered the closure of tanneries at Jajmau near Kanpur, unless they took steps to set up treatment plants.

Government initiatives for pollution control:

 National Air Quality Monitoring Programme

Central pollution control board has been executing a nation wide programme of ambient air quality monitoring known as national air quality monitoring programme  to determine status and trends of ambient air quality and to understand the natural process of cleaning in the atmosphere to undertake preventive and corrective measures.

National Air Quality Index

• Launched by environment ministry in april 2005.
• Initiative under Swachh Bharat.
• It helps to common man to judge the air quality within his vicinity.
• Index constituted as a part of government’s mission to improve the culture of cleanliness.

Other alternatives

• Government is disincentivising use of private vehicles through congestion charging.
• The national green tribunal has ordered that diesel vehicles over 10 years old not ply on Delhi roads.
• Odd even formula.
• Making city rules friendly to bicycle users.
• Promoting roof top solar power as an alternative to coal power.
