RIGHT TO PRIVACY

ABSTRACT

Article 12: No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks. The International Covenant on Civil and Political Rights in its Art. In this Article my point is toward rights of privacy provided to every citizen of our country.

INTRODUCTION

Right to privacy is a right which an individual possesses by birth. Privacy, simply means the
right of an individual to be left alone which is recognised by common law. Every one of our country should have to enjoy this right under common Law. The Preamble of Indian Constitution guarantees liberty of thought, expression, belief, faith and worship to all the citizens of the country. A paralysis of Article 21 of the Indian Constitution which includes the word “personal liberty” reveals that for an individual to lead a dignified life, his/her liberty should be protected which ultimately demand right to privacy to be given legal recognition. Privacy is a fundamental right granted to every global citizen. It’s the basis of human dignity and freedom. The right to privacy is shown and acknowledged in all the major constitutions, and India is no different.

DEFINATION

Privacy is a primordial right which ensures the dignity of the individual. ‘Right to be left alone is the best thing one can have in the modern world’. The judgment specifically mentions three privacy:- Decisional autonomy, Informational privacy, Physical privacy. This judgement will protect individual from the abuse of powers arbitrary.

IMPORTANCE OF RIGHT TO PRIVACY

It is important for protection of human dignity and is one of the essential pillar for a democratic nation. It supports one’s own rights and others rights as well. The right to privacy is to restrain government and private actions that threaten or hinders the privacy of individuals.

REASONS

1.) Privacy rights prevent the government from spying on people (without cause).

2.) Privacy rights keep groups from using personal data for their own goals.

3.) Privacy rights help ensure those who steal or misuse data are held accountable.

4.) Privacy rights help maintain social boundaries.

5.) Privacy rights help build trust.

6.) Privacy rights ensure we have control over our data.

7.) Privacy rights protect freedom of speech and thought.

8.) Privacy rights let you engage freely in politics.

9.) Privacy rights protect your finances.

CONCLUSION

Right to privacy is a requisite of right to life and personal liberty under Article 21 of the Indian Constitution. Right to privacy is not an absolute right, it may be subject to certain reasonable restrictions for prevention of crime, public disorder and protection of others but, it may, apart from contract, also arise out of a specific relationship that may be commercial, matrimonial or even political and also where there is a conflict between these two derived rights, the one, which advances public morality and public interest, will prevail.
