Article 21 of Indian constitution guraates right to human dignity and respect but it has not been the case for lgbtq community they faces discrimination, harrsament still date in many parts of the country.
On 8 September 2018 Independence was given to LGBTQ community as the judgment of apex court came in the case navjot Singh johar v/s union of India which have stuck down a part of section 377 of Indian Penal Code 1860. Even after all this still LGBTQ community faces discrimination. Indian society still have not accepted them with open arms in many parts of the country they are still not treated as equals and they are not respected further same sex marriage is still not legal in Indian system.
CASE:
NAZ FOUNDATION V/S UNION OF INDIA
A public interest litigation was filed by Naz Foundation it is an non government organization which working in the field of hiv prevention they found section 377 as an problem while working for the cause so they file PIL in high court The high court dismissed the petition and then petitioner went to Supreme Court . The Supreme Court felt they are some facts which has not been covered so it sent it back to high court. The petitioner said section 377 of Indian Penal Code voilates Article 21 ( right to life with respect and dignity) Article 14 ( right to equality) Article 15 Article 19( right to freedom) . In 2006 National aids Control organization also filed affidavit saying section 377 is a problem for hiv prevention. The high court then gave the judgment that section 377 of Indian Penal Code voilates Article 21 ( right to life with respect and dignity) Article 14 ( right to equality) Article 15 Article 19( right to freedom).
Case: SURESH KUMAR KOSHAL V/S UNION OF INDIA
After the Delhi High Court Decision in Naz Foundation Case, 15 Special Leave Petitions (SLPs) were filed by many faith based and religious groups to consider the constitutionality of Section 377 of Indian Penal Code, 1860.
