Salus Populi Supreme Lex.

Introduction

This maxim Salus Populi Supreme Lex means regard for public welfare is the highest law.If the legal right of an individual is violated, there is a remedy for it. But, in some cases, law takes no action even if a violation of a legal right caused to a person. This is based on this maxim.

In Pranballav Saha V. Tulsibala Dassai (AIR 1958 Cal 713) it was ruled that all other maxims of the public policy must yield to the rule that regard for public welfare is the supreme law for the object of all law is to promote the general well-being of the society.

There should be a justification for the violation and the violation should be only to a extent it is required.

Conclusion

This maxim is based on the principle of the common social understanding that the welfare of the community have more importance than the individual welfare.
