ABSTRACT-
The article basically talks about the Misuse of Section 295-A as a weapon against entertainment content over OTT platforms. Religion in India is a very sensitive topic and hence most of the headlines nowadays are covered with communal riots, disruption in the lives of people, vandalization of temples, mosques etc. SECTION 295-A of the IPC states that whoever, with deliberate and malicious intention of outraging the religious feelings of any class of [citizens of India] [by words, either spoken or written, or by signs or by visible representations or otherwise], insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to [three years] or with fine or both. People like Zakir Naik, Asduddin Owaisi, Yogi Adityanath etc with their speeches spread hatred and thus creates communal tension between the communities just to maintain their position in the society and we will be studying more about it in detail.
INTRODUCTION-
As in the case of India, Religion is a very sensitive topic to be discussed among the communities of different faiths. India is the only secular country in the world, where there is no official state religion hence the tension as diversification among communities leads to different opinions and tensions. Nowadays, various OTT Platforms and social media platforms that are circulating fake news with concern to religious aspects and who want to increase their viewership in the name of these fake news. Political leaders just for the sake of winning the elections or the actors who just want to promote their upcoming films or to achieve fame among the audience starts giving hate speeches hurting the sentiments of millions of people in the country. People have deep faith in their gods and they whole heartedly pray to them and have immense faith in them but whenever someone tries to hurt their sentiments they feel agitated which results in eruption of violence and hatred.
MAIN ISSUE–OTT basically means that when the content of films and television is made available to viewers through the internet, without any cable network and satellite channel, it is called OTT. The main purpose of OTT is to generate knowledge and information in depth in the society but the vice-versa is happening and hence they are violating the basic norms.
Nowadays, the contents which are being shown on them just agitates the masses as their religious sentiments gets hurt, the immense faith and belief which they possess towards their gods and goddesses gets violated and more importantly it mental agony and sense of frustration in their hearts . Hinduism is a religion where there are lakhs of gods and goddesses and OTT just to increase their viewership, shows contents like comparing a person equivalent to lord Vishnu or comparing Lord Ganesha with simple elephant, making a mockery of Hanumanji by describing him as Monkey God or showing obscene scenes related to Goddesses Kali, Saraswati, Durga etc. Same problems are faced by the people of other religions such as Muslims, Sikhs, Parsis, Jains etc.
