To begin with let us highlight the fact that the preamble of our constitution mentions India as a SOVREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and secures all its citizens JUSTICE LIBERTY EQUALITY AND FRATERNITY.
To our constitution the term SECULARISM is implicit. Secularism entails cultivating and comprehending respect for all religious beliefs. The word ‘SECULAR’ was added in our constitution through 42nd amendment with objective to spread the belief of respecting all religions throughout the nation. It emphasises that the state has no official religion and that all religions are respected equally and in matters of religion the decision of the state is always neutral and unbiased. Secularism also denotes the fact that the state does not promote any ‘’particular’’ religion nor does it interfere with any. Secularism was held as a ‘’basic feature’’ of the constitution by supreme court in the case of SR BOMMAI V. UNION OF INDIA.
The constitution forbids the marriage of religion and state power , which at times is done my political parties , any such practice is constitutional injunction. If any state government is found to be engaging in non secular activities and practicing that are in violation of the constitution will face measures taken in accordance to Article 356.
In India, secularism does not totally separate state and religion; the Indian constitution allows for considerable governmental participation in religious matters, such as the abolishment of untouchability and the opening of all hindu temples to the lower castes furthermore personal laws in modern India, such as divorce, inheritance, and alimony, differ depending on whether you are a Muslim or not.
The Indian constitution allows the state to provide partial financial support to all religious schools and infrastructure. There are a large amount of religious monuments or infrastructures which are maintained by the places of worships acts 1991 , Ancient monuments and archaeological sites and remains act 1958 and many more.
Secularism in India, with its significant contrasts from secularism in the West, is a contentious topic in India. Supporters of the Indian notion of secularism argue that it respects diversity and pluralism, while critics argue that it is pseudo secularism. Supporters argue that any attempt to establish a standard civil code that applies equally to all citizens regardless of faith would impose hindu sensibilities and ideals. The indian constituition which seprates spiritualism with Indian faith is neither anti religion nor pro religion but neutral.
To sum up, secularism is a thread that connects all Indian citizens together by not favouring one religion over another and treating all religions with same respect. India, as a secular country, does not link its politics to any religion, and Indians, regardless of caste or creed, are allowed to celebrate all religious holidays in the country and this inhibited concept is in the deep roots of the history of India. and will keep on blending with various spiritual traditions and social movements.and this inhibited concept is in the deep roots of the history of India. India as state has always maintained its feature of secularism and will always be a termed as a SECULAR STATE.
