What is Sedition ?

This section was drafted by Mr. Thomas Babington Macaulay and added in IPC in the year 1870. It was introduced by the British to oppress the voices of Indians which were rising against them. Punishments are also very rigorous, like a person who is charged with this offence can never apply for Government jobs. It is a non bailable offence.  It is also against the international commitments of India. In the year 1979 India has ratified the International Covenant on Civil and Political Rights which provide for the protection of rights of freedom and expression of everyone. However India by misusing the Sedition charges is not fulfilling its commitments.


India is one of the biggest democracies in the world and one of very important elements of a democratic country is giving Right to freedom of speech and expression to its citizen. But the Section 124A of IPC that is the result of colonial rule is against the democracy feature of our country. Nowadays the word sedition is considered as equal to the dissent and criticism of the Government in India and it is discouraging people from criticizing the Government and its policies which is giving government uncontrollable power and curtailing people’s right to freedom of speech and expression. In the month of January Chief Minister of Jharkhand Mr. Hemant Soren scraped 3000 cases of sedition saying that “Laws are not made to frighten and silence the people but to instill a feeling of safety in the public. My government will work towards being the voice of the people. We have recommended taking back the sedition cases registered against 3,000 people and also asked for action against the concerned official”

As per the newly published consultation of Law commission of India also it is high time for parliament to rethink about repealing section 124A of IPC as it is against the Fundamental Rights of People enshrined under Article 19 of the constitution of India.
