Article 85 of the constitution of india provides the power to summon the session of parliament, of which convener power rests inherently with the Government. Several other procedural formalities have to be fulfilled prior to the initiation of the session such as formalization of Cabinet Committee on Parliamentary Affairs by the President to decide the factors as to in whose name Members of Parliament are to be summoned to arrive at the meet for the respective session.
Although there are three sessions that are held in a year, none of them have fixed dates on the calendar.
✓ 1st session- ( Budget Session ) which also is considered as the longest session of all three. From the end of January generally it starts and gets concluded by the end of April or first week of May. The session also own the recess time in which usually the parliamentary committees are provided with time gap to discuss and raise issues over the budgetary proposals.
✓ 2nd session- ( Monsoon session ) the second parliamentary session last in general for three weeks of the beginning month of which is in general July and August is somewhere it finally sign offs.
✓ 3rd session- ( Winter session ) the month of November to december is when the parliament witnesses the third and closing session for the year.
CALLING/SUMMONING THE PARLIAMENT
When the members are called to gather for the meeting (session), the process is known as Summoning.
The gap between two sessions cannot exceed for more than 6 months which mandates the meeting of parliament for atleast two times a year, if not three. The power of summoning the houses of parliament rests with the President, who makes sure that timely summoning of each house takes place.
ADJOURNING PROCEEDINGS
Provided the reason of long sessions of sitting, which involves weeks and months straight at times, sometimes proceedings are postponed to a definite or indefinite time period. Antonymous to the end of session the adjourning of house meet is just a shift to future of fixed gathering. There are basically two types of Adjournments in the sitting houses;
General adjournment– Adjournment which terminates the sitting of the House to meet again at the time appointed for the next sitting. The postponement of which often is for a specified time such as hours, days or weeks.
Adjournment sine die- When the meeting is terminated without any definite time/ date fixed for the next meeting.
PROROGATION AND RECESS
Whereas Adjournment is just a shift of session and meeting of the houses, Prorogation to the contrary is the end of the listed session. A prorogation proceeding puts an end to the entire session.
The time period after Prorogation until reassembling of the houses is known as Recess period.
QUORUM MANDATE
For a meeting of the house to be procedurally conducted, there has to be a minimum number of members present as a requisite, which is only known as Quorum, as a mandate. The Constitution has fixed one-tenth strength as quorum for both Lok Sabha and Rajya Sabha. Concluding which it can be observed that for a sitting of Lok sabha there must be 55 or more members present , whereas in the case of conducting a meet/sitting of Rajya sabha atleast 25 members as a minimum prerequisite must be present.
