Sexual harassment in the workplace is neither new nor uncommon; nonetheless, it is not widely recorded or discussed. In some form or another, most working women endure sexual harassment at work. It’s always been there, but it’s never been acknowledged. It is, in fact, a continuation of patriarchal violence at home and in society at large, but it is insufficient. At its most fundamental level, it is a display of male dominance and an inability to deal with women on an equal footing with men. One of the most common ways that men reject gender inequities in the social system is through sexual harassment. The possibility of women being harassed is limitless. The Constitution has established a number of safeguards to preserve women’s rights and status, one of which is the enactment of the Sexual Harassment of Women at Work (Prevention, Prohibition, and Redress) Act 2013.
In the case of VISHAKA V. STATE OF RAJASTHAN, the concept of “sexual harassment” was defined by the courts, including the Supreme Court. Sexual harassment has been identified as a kind of sex discrimination manifested through unwanted sexual advances, resulting in a hostile working environment for woman.
Women’s rights to equality and dignity are grossly violated when they are sexually harassed at work. This has a negative influence on people’s lives and livelihoods, as well as lowering productivity. As a result, women’s participation in the workforce will increase, leading in economic empowerment and inclusive growth. It will also help them realise their entitlement to gender equality in the workplace, if and wherever they work.
