SINGLE PARENT ADOPTION IN INDIA

INTRODUCTION: According to research by the Indian Association for Promotion of Adoption and Child Welfare, the number of unmarried women in India who wish to adopt is constantly increasing, fueled by a desire to start a family.

The Hindu Adoptions and Maintenance Act, 1956, regulates adoption for Buddhists, Jains, and Sikhs in India.

Because Muslims, Parsis, Christians, and Jews do not recognize complete adoption, if a member of one of these religions wishes to adopt a child, he or she can apply for guardianship under Section 8 of the Guardians and Wards Act, 1890.

The CARA Guidelines and Adoption Regulations, 2017 and the Juvenile Justice (Care and Protection of Children Act, 2000) are supplemental acts to the adoption action.

AGE LIMIT FOR ADOPTION IN INDIA: In India, the minimum age for single mother adoption has been lowered from 30 to 25. The adopting single man must also be at least 25 years old. Single male and female parents between the ages of 45 and 50 can adopt a child under the age of four, while those between the ages of 50 and 50 can adopt a child between the ages of five and eight. Adoption is available to people under the age of 55 who are between the ages of 9 and 18. After this age, adoption is not permitted.

PROCEDURE FOR ADOPTION: The following steps may be included in the adoption process:- Potential parents must complete an online registration form. They can do this with the assistance of the District Child Protection Officer (DCPO). The application form can be found on CARA’s official website.

The adoption agency creates a home study report within 30 days of registration, noting the prospective parents’ various compliances and considerations, and then uploads it on its database.

Adoptive parents can look through photos and medical histories of children to help them choose a child who suits their tastes and preferences.

Adoptive parents have up to 48 hours to reserve a child for adoption.

The adoption agency will set up a meeting between the potential parents and the child of their choice, as well as assess their suitability.

The future parents must sign the child study report if the match is compatible. As a witness, a social worker must be present.

If the match is not compatible, the process begins all over again. The entire matching procedure normally takes about 15 days.


ADOPTION RULE FOR THE SINGLE MALE AND FEMALE: The Central Adoption Resource Agency (CARA) guideline, issued by the ministry of women and child development in 2015, allows a single woman to adopt a child of any gender. The juvenile justice legislation prohibits a single male from adopting a female child.

COSTS INCURRED IN ADOPTING A CHILD IN INDIA: According to CARA guidelines, adoption in India should cost no more than Rs 46,000, which includes Rs 1,000 for registration, Rs 5,000 for the home study procedure, and Rs 40,000 for the agency’s official child-care corpus fund.

These costs are spread out throughout the duration of the adoption process rather than being paid all at once. Many institutions and non-profits provide loans and grants to assist families in realizing their adoption ambitions. Consult an adoption expert if you have questions about financial aid.

CONCLUSION: Adopting a kid is a great purpose that should not be overshadowed by religion, caste, or other limitations. A couple who wants to raise a kid but can not because of a biological deformity, or a single parent who wants to adopt a baby but can not because he is not married, should not be refused adoption, and I believe the right to adoption should be incorporated in the country’s Fundamental Rights.
