Plea in Allahabad High Court to ban use of loudspeakers for religious recitation or call to prayer A plea before the Allahabad High Court seeks a ban on sound amplification devices for religious recitation and calls to prayer at temples, mosques and churches in UP. The organisation has requested the high court to order the Tricity police to provide all police stations and patrol cars with noise meters and enforce the ban on amplifiers even during daytime. The application also addresses the issue of the use of loudspeakers by religious places as it is resulting into lots of noise pollution. The first signs of sleep deprivation are unpleasant feelings of fatigue, irritability, and difficulties concentrating. Prolonged sleep deprivation will eventually kill a creature.
During sleep, the immune system performs a host of vital regenerative functions that are absolutely necessary for a healthy mind and body in waking life. When a person is deprived of sleep, the immune system becomes unable to perform these functions. Representing the applicant during the resumed hearing, advocate Navkiran Singh argued that even the Supreme Court had agreed in a judgment that: “Sleep is essential for human race to maintain the delicate balance of health necessary for its existence and survival. Sleep is fundamental requirement without which the life will be in serious and immediate danger. Then come problems with reading and speaking clearly, poor judgment, lower body temperature, and a considerable increase in appetite. To disturb sleep amounts to torture, which is now accepted as a violation of human rights and it is of great necessity for such restrictions to be imposed.”
The complaining organisation submitted that police were not sufficiently strict in responding to noise at night and they even didn’t have the instruments to measure the decibel level. “Cops refuse to take action before 10pm, even when told that noise limits applied even during the day,” advocate Navkiran Singh stated adding that details secured in 2017 under the Right to Information Act suggested that all police stations in Haryana and many in Chandigarh didn’t have any noise meter. He called for action against lazy cops and the playing of loudspeakers at religious and social events.
The deputy commissioner of Panchkukla police moved an affidavit in the high court, stating that of the 10 parties allowed to use loudspeaker between October and December 2018, none had given police any reason to complain. However, Mohali senior superintendent of police (SSP) Kuldeep Chahal said: “Two complaints were received in the town on November 16. We could not locate the first violator but we arrested the others and managed to stop the loud music.”
During last hearing, the UT authorities had blamed surrounding areas for all the noise pollution in Chandigarh Justice G S Sandhawalia had taken a serious note of the playing of loud music until 3.45am at the wedding of Kansal councillor Taranjit Kaur’s son for three nights in November , observing that many animals of the Kansal forest were sensitive to noise, and wildlife sanctuaries were shrinking already on account of human greed.
