IPC that means The Indian penal code 1860.
1. IPC is a substantive law which defines the offence and punishment for that offence. 2. Lord Macaulay known as the father of IPC .
3. IPC was enacted in 6 October 1860 but enforced on 1 January 1862 .
4. IPC applicable in whole of India and also applicable on J&k after removal of Article 370.
5. IPC is divided into 23 chapters 511 sections .
6. IPC was drafted by the first law commission .
Needs to Reform IPC :-
Reforming the criminal justice system is not just a one step process . Revamping IPC is major step to modernize the criminal law of India and make it accordance with the Indian democracy . The Britishers used IPC to their advantage and to put away freedom fighters , it was based on the deterrent theory. But now shift has to be made from a deterrent to reformative system . Revamping IPC will ensure that the criminal justice system will become more reliable and have the potential to understand and answer behind today’s crimes. It will also ensure that certain provisions of this age code that are not relevant today . Are repealed. For example section 377 of IPC which criminalised homosexuality but discriminalised accordance with the changes in modern era.
