A son in the Hindu family was considered important because it was presumed that a son in the family would complete religious obligations such as pind daan and continued the legacy of the ancestors. Hence the concept of adoption was devised. Earlier a daughter was not adopted. It may safely be concluded that the validity of an adoption is to judged by spiritual considerations. Personal laws have their own system of adoption. Muslim community does not recognize adoption. There was no procedure during British rule but the old Hindu law recognized adoption as a sacrament and only a son could be adopted. An orphan and illegitimate kid could be adopted and a Hindu could not adopt a child, whose mother he couldn’t marry under the law. The Hindu adoption and maintenance act 1956 brought some changes. It allowed for the adoption of a daughter, it allowed the adoption of an illegitimate or an orphan child. Consent of the wife is considered important. With the Hindu adoption and maintenance act coming in play the adoption was no more sacred hence no religious ceremony to adopt a child was deemed necessary. Adoption means the removal of the child from his natural parents with all ties severed and placing it into the adoptive family where all the ties came into existence. The rights were not limited to adoptive parents but to the relations on both the maternal and paternal sides of the family.
As per the Hindu adoption and maintenance act 1956, the parents intending to adopt a child needs to present an application before the child welfare agency. Registration of both the parents and the child can be done by any agency which is duly certified by the Central Adoption Resource Authority. The next step would be the interview which will be conducted by registered agents in order to find out the intention of the adoptive parents. It is after which the adoptive parents decide which child they want to adopt and then they have to file the petition in the court after which the court starts the hearing followed by a decree and then adoption is finalized.
