THE DECLARATION FOR THE RIGHTS OF HUMAN

INTRODUCTION

Human rights are rights inherent to human beings, regardless of race, sex, religion, nationality, ethnicity, language, religion or any other status. In 1948, the United Nation General Assembly proclaimed the Universal Declaration of Human Rights (UDHR) for all the people around the globe.

UDHR lays down many objectives and provides a common standard of achievement for all the people and nation. Every individual shall promote these rights and freedoms by progressive measures. These rights include right to life & liberty, freedom from torture, slavery, freedom of expression & opinion, right to work & education, etc.

It represents the recognition of basic rights and freedom inherent to all Human beings, inalienable & equally applicable to everyone and that everyone is born free and equal in dignity & rights. Whatever our nationality, place of residence, nationality, religion, color, language, etc. the international committee on human rights made a commitment to uphold dignity & justice for all.

UDHR today is considered as the legal baseline for modern international human rights law. Although not intended as a legally binding instrument at the time of its adoption, the UDHR clearly acknowledged in its preamble, the essential need to protect human rights through the rule of law.

The human rights role of non-state entities such as non-governmental organization (NGOs) has increased tremendously. New perspectives have also evolved regarding responsibilities and remedies for human rights violations.

INDIA & UDHR

The drafters of The Indian Constitution have undertaken a careful comparison of the constitution of the United States, Ireland & the UDHR. It is the longest written constitution in the world. It also is one of the foremost Constitutions to have a separate chapter on Fundamental Rights signifying sovereign obligations to uphold human rights and freedoms to its citizens.

A number of fundamental rights were guaranteed to individuals in Part III of the Indian Constitution are similar to the provisions of the UDHR.

The founder of the constitution appears to be more conscious about the contents of the Declaration, and therefore they gave due recognition to its provisions.

The UDHR may not be a legally binding instrument, but it shows how India understood the nature of ‘Human Rights’ at the time of the Constitution was adopted.

LEGAL EFFECT OF UDHR

The declaration was not intended to be legally binding and therefore it did not impose any legal obligations on the states to give effect to its provisions. The Declaration was only a recommendation from its legal point of view.

The United Nation commission believed the weightage of the draft is more when people know them, people understand them, people demand them to be lived. The human rights come into existence in the neighborhood he lives in; the school or college he attends; the factory, farm, or office where he works. Such are the places where every man, woman, and child seek equal justice, equal opportunity, equal dignity without discrimination. 

The declaration proclaimed a common standard of achievement for all people and all nations to promote & secure the effective recognition & observance of rights & freedom.

The objective of the declaration was to present the ideals of human rights & freedom in order to inspire everybody to work for their progressive realization.

IMPACT OF UDHR

The declaration has exercised a profound influence upon the minds of men. It has been the source of inspiration and has been the basis for the United Nation in making advances in standard setting as contained in international treaties on human rights.

The tremendous evolution of international human rights calls for in-depth reflective analyses on the subject. The most unpromising cultural environment is the traditional Hindu caste system, which not only discriminated the descent-based group (castes) but even denied the moral significance to a group of human being. And reformer from India showed up to reshape Hindu Tradition to support the conception of human rights. Thus, one of the hopes of the UDHR has been increasingly met. And India has been one of the leading supporters of internationally recognized human right.

International legal, overlapping consensus & functional universality are all essential normative. UDHR establishes international legal obligations. UDHR contained a comprehensive list of social, economic & cultural right.

We cannot have peace & safety without some basic rights which are shrined in the UDHR. It is a promise and commitment among nations to sustainable development. The UDHR has helped in preventing violations, obtain justice, protect human rights & laws and give strength to the nation.
