THINK BEFORE YOU FORWARD

INTRODUCTION

In today’s media systems, people are more likely to encounter false and misleading information on a daily basis and it has become a grave concern for the Supreme Court (SC). In a recent report, SC raised a grave concern over the fake news circulating social media.

There is no accountability against institution of such news and misinformation as social media listens to powerful voices. There’s no control over such fake news rambling on social platforms.

The rapid growth of social media in recent years has empowered them to be present in every aspect of our lives from comfort, security, entertainment, e-commerce to political campaigns.

From technology point of view, mobile devices incorporate a powerful electronic & telecommunication system which promote modes of learning system through social network.

Despite all the advantages offered, studies have found difficulties which cannot be ignored. The level of security & privacy is not adequate to facilitate the tracking of any user.

Most of the fake news or post on social media websites wants to make money from their misleading articles on the portal.

MISUSE OF SOCIAL MEDIA

With such a population dependent on social media platforms, the tech-giants cannot choose to ignore the consequences pertaining to such use of social media. The platform which shares morphed images of women, deep fakes & many other contents that threaten the dignity & security of women. Mainstream news is filled with hype, fear and content produced for rating

There are many instances where abusive language, defamatory contents and hate speech in these platforms have become very common. The series of action taken by these platforms to get views & advertisements fails to identify the useful content and fake or harmful content.

The emerging of such cases has raised concern for the SC and therefore it has directed the government to curb and stop broadcasting of messages and videos on social media which have tendency of spreading rumors and incite violence.

The SC has set up new guidelines upon the observation and mandated serious rules and regulations which provide safety and eliminate content which are fake, unethical & disturbing.

If we are motivated to believe negative things about someone, we are likely to trust outrageous stories about them.

GRIEVANCE REDRESSAL PROGRAM

The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 were released by the Ministry of Electronics and Information Technology in February and urged the social portals to comply with the new rules with speedy redressal.

The new rules aim to empower ordinary users of social media platforms and OTT platforms with a mechanism for redressal and timely resolution of their grievance with the help of Grievance Redressal Officer.

Any person having a grievance regarding content published by a publisher in relation to the Code of Ethics may furnish his grievance on the grievance mechanism. The publisher shall generate and issue an acknowledgement of the grievance for the benefit of the complainant within twenty-four hours of it being furnished for information and record.

Each and every user of the social media platform shall be entitled to abide by the rules laid down by the ministry of electronic & Information Technology irrespective of the country of residence and follow the redressal mechanism for such an issue arising out of such fake news.

Our constitution has given us fundamental right to express our speech our thoughts, but there is certain exception laid down under article 19(2) which has given exception for restricting thoughts of violence, defamation, rumors, inappropriate & inciting hatred. The fundamental rights are base to our democratic structure. To secure its stability, it is necessary to comply with fundamental duties under article 51A.
