In our society whatever matter we totally avoid or ignore, slowly that matters start to get converted into acceptance and seems to be normal to us. For example Blockbuster movies like Dabangg, Sacred Games, Rowdy Rathore, Simba etc in all these movies the common concept was police brutality and torture. It has been observed that whenever these things such as action and fake encounted have been shown in movies viewers appreciate that and promote it. According to the average viewers the work of police is not only to maintain law and order his duty is also to arrest the villains and finish them.
In US after the death of Goerge Floyd and in Tamil Nadu after the death of Bennix and Jaya Raj have raised various concerns related to police torture and third degree treatment. After the huge protest that raised after the Gorge Floyd incident made the congress introduce a new Police Reform bill and introducing a national database policy for police misconduct.
In India also a similar bill “Anti torture Bill” was introduced in 2010 which was discussed in parliament a various number of times but was never passed.
Now India is a member of UN to apply any law by UN in India it has to make a law for it so to make a law against action of torture bill 2010 was presented in Lok Sabha.
So according to the bill if any public authority commits torture, punishment are prescribed in this bill, this bill very simply explains the bill , as if any public authority or sevant in order to derive any kind of information from any individual, hurts that individual for mentally and physically torture an individual, so a punishment for 10 years will be given. This bill is passed from Lok Sabha to Rajya Sabha and Rajyasabha select a committee for the suggestions.
The suggestions are as follows:-
1. To expand the definition of torture
2. Torturing women for child should have severe punishments.
3. An independent authority should be set up which will investigate all such activities and provide compensation to the victims.
Considering all the suggestions husband presented in Rajya Sabha numerous number of times but still this bill has not been passed.
In 2017 Law Commission said “we are seriously considering the bill”
But before bringing the bill certain changes will be required those are as follows:
1. Indian Penal Code
2. Indian Evidence Act
3. Criminal Procedure Code
In 2019 India had more than 1700 custodial deaths.
