Most of the times, justice is taken as a synonym to morality i.e., to see whether a cause is right or wrong, serves society with a greater purpose, or to simpler terms, does it deems fair for a particular individual and society together?
There is a thin line between justice and morality, where morality only looks at right or wrong, not considering the adverse consequences it might have, on the other hand, justice sees to it, that no one is discriminated, everyone is treated equally and if there is any inconsistency with their fundamental right, or if they are trapped in an unfair situation, justice to the person would be help resolve the situation, compensate or restitute.
Justice is subjective. It varies from person to person and situation to situation. What justice for me is different for any other reasonable person. But the foundation for the justice id given in our constitution. Article 14 of the Indian constitution talks about, that every person should be treated equally and everyone should have equal protection of law.
Justice does not see to it, whether a person is poor, rich, black, white, generous or evil. Justice is equal to all of those who come before the court of law, to either resolve a dispute or come for aid. Everyone is heard, and justice is given accordingly. Whereas, no one is denied of justice based on gender, sex, race, caste and religion. Justice is given by hearing all the parties and no one is left unheard which is stated in Latin maxim called “audi alterm partem”.
Justice is considered looking at what a person has suffered, mentally and physically and how much they can suffer further. Justice can be in form of injunction or compensation or whatever the lordship deems fit in the interest on justice, equity and good conscience.
