The term patent finds it’s roots from the Latin word patere, which means “to lay open”. It is a shortened version of the term letters patent, which was an open document issued by a monarch or government granting exclusive rights to a person. In modern times, the term patent usually refers to the right granted for inventing something new, useful and non-obvious. So a patent in general is nothing but a type of intellectual property that gives its owner the right to exclude others from making, using, or selling an invention for certain years, in exchange for publishing an enabling public disclosure of the invention. The person in whose name the document is issued is known as the patent owner. Other companies or entities in return of monetary consideration termed as royalties can enter into agreement in order to sell, produce or re-sell the invention. Such agreements are called license agreements. In India the term of every patent inis 20 years from the date of filing of patent application.

This monopoly right which is given by patent acts as an incentive to promote research and development which leads to inventions. In return of the benefit given by patents it is ensured that the patent owner describes the invention, the making of the inventions and the working of the invention. It is done to ensure that after the patent term expires, any person interested can gather the information and manufacture similar or the same product. Thus patents on the one hand promotes
research and development and on the other hand ensures that the public continues to get the benefit from inventions. One of the most notable examples of patents in the past 40 years is the patent of the personal computer filed in 1980 by Steve Jobs and three other employees of Apple Inc. Other examples of patents are King C. Gillette’s safety razor which was patented in 1904.


In India the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) also known as the Indian Patent Office, is an agency under the Department for Promotion of Industry and Internal Trade which administers the Indian law of Patents, Designs and Trade Marks.
