WHAT IS COPYRIGHT?

Copyright refers to the legal right of the owner of intellectual property. In simpler terms, copyright is the right to copy. This means that the original creators of products and anyone they give authorization to are the only ones with the exclusive right to reproduce the work. Copyright law gives creators of original material the exclusive right to further use and duplicate that material for a given amount of time, at which point the copyrighted item becomes public domain.[i]

WHY SHOULD COPYRIGHT BE PROTECTED?[ii]

Protection of copyright is granted under Copyright Act, 1968, which grants exclusive rights to create, sell and be known as its original author of the work. It is important to protect someone’s original idea or piece of creative work. Copyright should be protected because of the following reasons:

• Someone’s original work is their asset: if someone has an original idea or work, it is a potential asset and should be treated the same. It can end up having considerable value in the future and can even have financial value. This is why, the concept of copyrights as a legacy as they can last for decades and be passed down as part of an estate.
• Protect one’s right: if someone infringes a person’s copyright, the person will have a legal ground to ask for compensation for any financial loss one may have incurred.
• Copyright protection is important as it helps to protect the value of an author/academic/researchers work, by giving the originator of the work the ability to protect it from unlicensed or uncredited usage. This leads to the prevention of their work being copied to the degree where they cannot sell it effectively or receive credit for it.  In this way, copyright fosters intellectual creativity as it provides an incentive for a creator to work freely, allowing them to gain recognition for their work as well as protecting their livelihood.
• Copyright should be protected to protect and safeguard the original creativity of the creator. This brings added economic and social development of the creator and the society as well.
• If someone’s work has attracted the interests of other parties, the owner/creator can license their work to make sure they get financially benefited from their use. Licensing is a legal authorisation from you to another party that permits them to use some (or all) of your copyrighted works.

CONDITION FOR COPYRIGHT PROTECTION

The following are the conditions needed for conferring copyright protection to works:

(a) The work must be made or first published.

(b) There should be no copyright in the work in India at the time of making or on the first publication of the work.

(c) If the work is published in pursuance of an agreement with the author, such agreement should not reserve the author any copyright in the work or any copyright in the work should belong to the organisation.
